Terms of Service

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

We may update these Terms from time to time. Updated Terms become effective when posted to this page. Your continued use of the Service after updated Terms are posted means you accept the revised Terms.

2. Eligibility and Accounts

You may use the Service only if you can form a binding agreement under applicable law. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

You are responsible for providing accurate account information, maintaining the security of your email-based login access, and for all activity that occurs under your account or using your access credentials.

3. Use of the Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for personal or internal organizational use in creating golf pools, submitting entries, and viewing related standings and results.

• Use the Service only in compliance with applicable laws, rules, and regulations.
• Do not impersonate another person, misrepresent your affiliation, or submit false information.
• Do not interfere with the Service, attempt unauthorized access, scrape the Service at scale, reverse engineer it, or bypass any usage restrictions.
• Do not use the Service to harass, abuse, defraud, cheat, or otherwise harm us or other users.

4. Pools, Entries, and User Content

The Service may allow you to create pools, assign pool settings, submit team names, provide participant names, and make player selections. You retain ownership of content you submit, but you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, adapt, display, and use that content as necessary to operate, maintain, and improve the Service.

You represent that you have the necessary rights to submit your content and that your content does not violate any law or third-party rights. We may remove or refuse content that violates these Terms or creates legal, operational, or reputational risk.

5. Intellectual Property

The Service, including its software, design, text, graphics, logos, and other materials, is owned by us or our licensors and is protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, no rights are granted to you.

6. Service Availability and Changes

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We do not guarantee that any feature, tournament data, scoring view, or leaderboard function will always be available.

Tournament data, standings, rankings, and related information may be delayed, incomplete, or inaccurate, especially when sourced from third parties.

7. Suspension and Termination

We may suspend or terminate your access to the Service, remove content, or disable pools or entries if we reasonably believe you violated these Terms, created risk for other users, or exposed us to legal or operational harm.

Sections that by their nature should survive termination will survive, including ownership, disclaimers, liability limits, indemnity, and dispute-related provisions.

8. No Gambling or Prize Guarantee

The Service is intended for entertainment purposes only. If you use the Service in connection with any pool, contest, or arrangement involving entry fees, cash prizes, or other things of value, you are responsible for determining whether that activity is legal where you live and where other participants are located.

Unless we explicitly state otherwise in writing, the Service is provided as a pool management and tracking tool only. We do not guarantee the legality, administration, payout, collection, or enforcement of any private contest, side arrangement, or prize structure created by users.

You are solely responsible for ensuring that any pool you organize or participate in complies with applicable laws and rules in your jurisdiction.

9. Third-Party Services

The Service may depend on or link to third-party providers for hosting, authentication, email delivery, payment processing, analytics, or data feeds. We are not responsible for third-party services, and your use of those services may be subject to separate terms and privacy policies.

10. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, and availability.

We do not warrant that the Service will be uninterrupted, secure, error-free, or free of harmful components, or that any data or results will be complete, accurate, or reliable.

11. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, business opportunities, or anticipated savings, arising out of or related to your use of the Service.

If we are found liable for any claim arising out of or related to the Service, our total liability will not exceed the greater of one hundred Canadian dollars (CAD $100) or the amount you paid us, if any, for the Service in the twelve months before the claim arose.

12. Indemnification

You agree to defend, indemnify, and hold us harmless from and against any claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable legal fees, arising out of or related to your use of the Service, your content, your pools or contests, or your violation of these Terms or applicable law.

13. Privacy

Your use of the Service is also subject to our Privacy Statement, which explains how we collect, use, and store personal information.

14. Governing Law and Disputes

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict of laws principles.

You agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the courts located in Ontario, Canada, and you consent to those courts' personal jurisdiction and venue.

15. General Terms

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of that provision. These Terms, together with any policies expressly incorporated by reference, form the entire agreement between you and us regarding the Service.
